Making the agreement real

  1. Link the terms from every page footer.
  2. Require a checkbox at checkout that references the terms and the research use condition.
  3. Save the confirmation with the order.
  4. Link the terms again in the order email.
  5. Date each version, and keep old versions.

Terms hidden behind a small footer link, never agreed to, are weak evidence. A recorded checkbox is strong evidence.
